The Indian Regulatory Framework: CA Foundation Law Chapter 1 Guide

Chapter 1 of CA Foundation Business Law is "The Indian Regulatory Framework". This chapter introduces you to how laws are enacted, implemented, and enforced in India. Understanding this is essential to contextualize the commercial laws you study in later chapters.
How a Law is Made in India (Legislative Process) 📜
Enacting a central law follows a structured path through Parliament:
- Drafting the Bill: The draft of a proposed law is called a Bill. It is drafted by the ministry concerned.
- Introduction in Parliament: The Bill is introduced in either house of Parliament (Lok Sabha or Rajya Sabha).
- Passing the Bill: The Bill must be passed by both houses of Parliament by the required majority.
- Presidential Assent: After being passed by both houses, the Bill is sent to the President of India for assent.
- Notification: Once the President gives assent, the Bill becomes an Act and is published in the Official Gazette of India, coming into force from that date.
Three Organs of the State
The regulatory framework is split into three independent organs under the Constitution of India:
- Legislature: The law-making body (Parliament at Central level, Legislative Assemblies at State level).
- Executive: The law-implementing body (Cabinet Ministers, bureaucrats, police, and government departments).
- Judiciary: The law-interpreting and dispute-resolving body (Supreme Court, High Courts, and Subordinate Courts).
